A $200 deposit from Buyer holds pick order based on date received.

Seller's guaranty on health of pup:
Pup has had a CERF eye exam by a veterinary ophthalmologist and pup's eyes
are normal and free of CEA or other sight restricting abnormalities. OR, one or
more
of the Parents of the pup are DNA certified CEA/CH Normal and the pup is not
affected due to parentage..
Pup's parent’s hips are OFA certified and/or Penn Hip certified and eyes CERF
normal each year.
Pup has first shot series at 8 weeks of age and has been wormed at 2, 4, 6, & 8
weeks of age.
Pup has been examined by veterinarian prior to leaving and has no sign of health
problems
Pup's hip Guarantee:
Buyer must have an OFA prelim done on Pup by no later than 9 months of age, if
Pup is found to be Mild, Moderate or Severe dysplastic by OFA at that time,
Seller will offer a second pup for 1/2 price from a litter born at the Seller's
earliest convenience.
Pup's eye Guarantee:
Buyer must have a CERF examination done on Pup before 12 months of age, if Pup
is found to have a hereditary eye problem at that time that hinders the dog's
normal eye sight, which must be defined in writing by a veterinarian
ophthalmologist, Seller will offer a second pup for 1/2 price from a litter born
at the Seller's earliest convenience.
Pup's additional health Guaranties:
72 hour full money back guarantee:
Buyer must take Pup to a veterinarian within 72 hours of purchase for a health
exam. If Pup is found to have a congenital health defect buyer must immediately
return pup to Seller for a full refund of the purchase price (shipping, travel
and additional expenses not refunded), or, return pup and choose a pup from a
litter born at the Seller's earliest convenience.
After the 72 hour full guaranty:
If Pup is found to have a congenital health defect defined in writing by a
veterinarian prior to 12 months of age that limits the dog from normal
activities or dog sports, seller will offer a second pup for 1/2 price from a
litter born at the Seller's earliest convenience.
Only one replacement pup will be offered to Buyer regardless the number of
health problems found in Buyer's original pup
Results of a congenital health defect may need to be released to a veterinarian
of the Seller's choice at Seller’s discretion for a second opinion. In the event
that the second opinion differs from the first, a third non-partial
veterinarian's examination and opinion will be the deciding factor. If the
abnormality is not clearly defined and diagnosed by a general practitioner, than
a specialist must examine/ test dog to determine if the dog has a health
problem.
Buyer's obligations to honor contract:
Pup's hips x-rayed and results sent to OFA for evaluation before Pup turns 9
months old. A copy of the OFA results must be sent to seller within 2 weeks of
receiving such notification for guaranty to be honored.
Pup must have eye exam by a veterinary ophthalmologist before Pup turns 12
months of age and a copy of the results must be sent to seller within 2 weeks of
receiving such notification for guaranty to be honored.
All medical results whether normal or abnormal will be given to Seller within 2
weeks of findings
Buyer must provide proof of sterilization of Pup to receive a replacement pup
from Seller, or, return dog to Seller
Buyer agrees to not purposefully jump the Pup over 12” or expose the Pup to hard
exercise prior 12 months of age
Buyer agrees to feed the Pup a super premium food or raw diet
Buyer agrees to maintain Pup in good health, vaccinate dog appropriately, keep
Pup on heartworm prevention (where applicable) and take Pup to a veterinarian
for annual exams
Breeding the Pup:
Pup is sold with AKC registration papers. Pup is sold on a limited
registration ($800) or Full Registration with Co-ownership (1200) with Seller,
Alicia Ward. Limited Registration allows Pup to be shown in all
performance events, but limits Pup from showing in conformation and Pup's
offspring from being registered. Buyers wanting to show their Pup in conformation and/or
breed their Pup must Co-own the Pup on Full Registration papers with the Seller
for a period of time (see below). Or, the Pup's Limited Registration can
be changed
to Full Registration at a later date when the Buyer has followed the 7
below requirements and the additional $400 is paid to Seller.
**After the buyer has done the 7 following requirements the
Co-Ownership or Limited Registration can be removed by the seller making the buyer the sole
owner with Full Registration and breeding rights.
1. Pup receives AKC Championship, or, Pup receives at least one AKC Title in a
performance event or equivalent working degree
(CGC/ HIT do not apply)
2. Pup's hips are OFA certified Good or Excellent at 2 years of age/ OR/ Pups
hips are PennHip scored not greater than .55 on either hip
3. Pup's eyes are CERF Normal at 2 years of age and again within 1 year of
breeding (or within 1 year prior to change of papers)
4. Seller or Seller's representative re-evaluates the dog's temperament and structure and
Pup is found to have a stable temperament and is structurally correct
5. Pup is examined & CBC & Thyroid blood work drawn by a Vet after the dog
turns 2 years old and dog is found
to have no known health problems
6. Pup has a microchip &/or tattoo
7. Dog has DNA profile with the AKC
In the event that the Pup is unable to meet the above conditions, Buyer must
present proof of sterilization of Pup to Seller before Seller will remove the
co-ownership. Limited registration will not be changed if above conditions can
not be met.
Buyer agrees in the event of breeding the Pup:
Pup will be bred to an AKC registered Border Collie whose hips are
OFA certified Good or Excellent and eyes found CERF Normal 1 year prior to
breeding. This dog/bitch must also have at least one AKC title or equivalent
working degree (CGC/ HIT do not apply). In addition, this dog must be tested
Normal for DNA CEA/CH and CL and the results must be posted publicly. OR, this
Dog may be a known carrier if the Red-Dawn pup it is bred to is known to be
Normal for DNA CEA/CH and CL by parentage or by DNA Normal testing and results
are posted publicly.
Buyer agrees to offer a contract and guaranty to buyers of all progeny of Pup
A bitch Pup will not be bred prior to 2 years old and no litters after
8 years of age.
Bitch Pup will have no more than 7 lifetime litters with no more than 3 litters
in any 24 month period
Action against Buyer:
Any violation of this contract by buyer will constitute penalties including but
not limited to:
All gross income from Pup’s litter going to Seller
Full return of Pup and registration papers signed over to Seller
All court or Attorney's fees associated with carrying out this action paid by
Buyer
Additional agreements:
1. Buyer will not abandon dog. Buyer agrees not to give away, trade or sell Pup
without first notifying Seller of intent. If Pup is to be re-homed, the New
Owner's contact information must be provided to Seller.
2. Seller agrees to take back ownership of Pup and Buyer agrees to return Pup to
Seller if an appropriate home can not be found, plus, registration papers of Pup
signed over to Seller to become the sole owner of Pup.
3. In the event that Buyer chooses to advertise Pup for sale, Seller agrees to
help find Pup a suitable home by advertising the dog on the Red-Dawn web site
for a suitable fair-market-value price. Selling and screening shall be the
responsibility of the Buyer and moneys shall be paid to the Buyer by New Owner.
4. Seller is not responsible or liable for any transactions between Buyer & New
Owner.
Buyer agrees to notify Seller of change of contact information of email/ phone/
address
Buyer agrees to notify Seller of any health or temperament problem in Pup
Pup must be registered beginning with the kennel name Red-Dawn
Any additions or modifications must be agreed to in writing by both Buyer and
Seller
Legal action shall be initiated in the county of the Seller's residence
